Acceptance of terms

These terms of service govern your use of Soundmango and the services made available through our website, dashboards, and related products. By creating an account, submitting a track, purchasing a marketing campaign, accepting a campaign opportunity, or otherwise using Soundmango, you agree to these terms. If you do not agree, do not use Soundmango.

We may update these terms from time to time. Continued use of the platform after an update constitutes acceptance of the revised terms to the extent permitted by law.

Nothing in these terms overrides rights that cannot lawfully be excluded under applicable consumer or other mandatory law.

Definitions

Soundmango, we, us, and our refer to the entity operating the Soundmango platform.

Platform refers to the Soundmango website, dashboards, and related services, including our partner sites.

A user is any account on the platform. An artist is a user who submits a track and purchases a marketing campaign. A curator is a user who controls one or more playlists accepted into the curator network and who may accept paid campaign work.

The curator network is the set of playlists we have approved and the curators who control them.

A track is music submitted by an artist for quality review, matching, and marketing.

A marketing campaign (or campaign) is the paid promotional service an artist purchases. It covers the deliverables shown at the time of purchase: written feedback on the track from the curator, and promotional content about the track published on our partner site. Partner site is the website operated by Soundmango where that promotional content is published.

A campaign opportunity is a campaign shown to a curator as paid work they may accept or decline. Activation is a curator accepting a campaign opportunity. The duration is the time a campaign runs from activation, as stated at the time of purchase.

Playlist consideration is a curator reviewing a track for possible inclusion on a playlist. Playlist placement is a curator choosing to add a track to a playlist. Neither is part of a campaign.

Content refers to any text, audio, artwork, links, images, files, or other materials uploaded, submitted, published, or otherwise made available through the platform.

User accounts & registration

You must create an account to use features that require registration, and you must provide accurate, current, and complete information and keep it up to date. One account covers every role and every product.

Our platform involves payments and payouts and is not intended for users under the age of 18. By creating an account, you represent that you are at least 18 years old.

You are responsible for protecting your login credentials and for all activity carried out through your account. Contact us promptly at hello@soundmango.com if you believe your account has been accessed without authorization.

You may not create or use multiple accounts to evade restrictions, fees, enforcement actions, or these terms.

You may close your account at any time by contacting us. When your account closes, your access ends and your content may be deleted as described in our privacy policy. A campaign that has not been activated is closed and refunded in full, and a campaign that has been activated runs to its end under these terms.

We may suspend or terminate accounts that violate these terms, create risk for the platform or other users, or engage in fraudulent, deceptive, abusive, or unlawful activity.

How Soundmango works

Soundmango connects artists with the curators of vetted playlists. An artist submits a track, chooses the criteria a playlist should meet, sees the price, and purchases a marketing campaign. We review the track for quality, match approved tracks with relevant playlists in the curator network, and show the campaign to the curators of the best matches as a campaign opportunity. The first curator to accept activates the campaign and delivers it over the duration.

Playlist consideration takes place alongside the campaign and is governed separately under playlist editorial independence below. A campaign never buys a place on a playlist.

Our matching methods, scoring models, pricing logic, and internal decision logic are proprietary and may change over time.

Track quality review

Every submitted track is reviewed by us before it enters matching, and no curator sees a track that has not passed.

We reject tracks for reasons including inadequate technical or production quality, AI-generated music, suspected artificial or deceptive activity, rights concerns, platform-policy concerns, or other factors that make the track unsuitable for the platform.

If a track does not pass our quality review, the campaign is closed, the artist is told the reason and given constructive guidance where we can, and the purchase is refunded in full.

Passing the quality review does not mean that a suitable match or a curator willing to accept the campaign will necessarily exist.

Matching

We match approved tracks with playlists in the curator network that we consider relevant, based on the criteria the artist selected and on track, playlist, audience, quality, campaign, and historical data.

Artists choose criteria, not individual playlists, and we do not promise access to any particular playlist or curator.

A match means that we consider a track potentially relevant to a playlist. It does not mean that the curator has made any playlist decision.

We keep opening campaign opportunities to the curators of fitting playlists while suitable playlists remain available. The number, timing, and sequence of opportunities are determined by us and are not guaranteed. If no fitting playlist exists, or no fitting curator accepts the campaign, the campaign is closed and refunded in full.

Any probability, acceptance-rate, or placement figure displayed on the platform is an estimate based on past data, and is not a guarantee of a particular result for an individual artist or track.

Marketing campaigns

The artist pays for the campaign deliverables shown at the time of purchase:

  • Feedback: professional, constructive written feedback on the track from the curator. It belongs to the artist and is not published.
  • Promotional content: a blog post about the track on our partner site, generated by us from the campaign's details, published under the curator's name, disclosed as paid content, and kept online for the duration.

A campaign is activated when a curator accepts the campaign opportunity. From activation, the curator has the duration to deliver the feedback, and we publish the promotional content once the feedback is in. We verify each deliverable, and the campaign is complete when every deliverable has been verified.

The artist may cancel a campaign at any time before activation for a full refund. Once activated, a campaign runs to completion or ends as described under refunds and cancellations below.

If a curator does not complete the deliverables within the duration, the campaign is terminated on the curator's side. We then look for a replacement curator, and refund the artist if none is found.

Playlist editorial independence & platform compliance

Curators remain fully responsible for the editorial content of their playlists and may add or decline any track at their sole discretion.

The paid service purchased by the artist is the marketing campaign. Payment for a campaign is not payment for playlist placement, playlist position, playlist duration, streams, listeners, followers, saves, algorithmic exposure, or any other streaming-platform outcome.

We do not pay curators for adding tracks to playlists, and we do not make curator compensation conditional on any playlist or streaming-platform outcome. Whether a curator adds a track changes nothing about what either side pays or earns.

Playlist placement is never guaranteed. You may not offer, request, or accept payment, benefits, or other compensation in exchange for influencing playlist content, whether through Soundmango or outside the platform after connecting through it.

Artists and curators must also comply with the terms, policies, and rules of the streaming platforms and other third-party services they use.

Curator standards & obligations

To participate as a curator, you must control the playlists connected to your account, prove that control when we ask, and provide accurate information about them.

We review playlists before and during participation in the curator network, and may restrict, quarantine, or remove playlists that do not meet our quality, authenticity, audience, or platform standards. No user has a right to be listed, to stay listed, or to any particular number of campaign opportunities.

In addition to the rules on playlist editorial independence above, you agree to:

  • Keep each listed playlist public and available on its streaming platform
  • Never buy, generate, or artificially inflate followers, streams, plays, saves, or engagement
  • Never use bots, scripts, click farms, or other artificial engagement methods
  • Complete every campaign you accept within its duration, as shown to you when you accept it
  • Provide genuine, professional, and constructive feedback on the track
  • Accept publication of the campaign's promotional content under your name, disclosed as paid content
  • Comply with applicable law and the policies of the platforms you use

Artist standards & obligations

In addition to the rules on playlist editorial independence above, you agree to:

  • Own or control the rights needed to submit and promote the track, including all necessary recording, composition, artwork, and promotional rights
  • Submit accurate information about yourself and your music
  • Submit only genuine music that complies with our quality and platform standards
  • Not submit AI-generated music
  • Keep the track available on its streaming platform for the duration of the campaign
  • Not buy, request, or encourage artificial streams, followers, saves, or engagement
  • Accept that curators choose freely, that no playlist is obliged to add your track, and that the price is computed by us and is not negotiable
  • Comply with applicable law and the policies of the platforms you use

Content ownership & rights

Users retain ownership of the content they submit to Soundmango.

By submitting content, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, analyze, display, and use that content as reasonably necessary to operate, market, secure, and improve the platform, and to deliver campaigns purchased or accepted through it. This license ends when you delete your content or close your account, except for promotional content already published on our partner site, records of completed transactions, and what we need to comply with the law or enforce these terms.

By purchasing or accepting a campaign, you grant us and the participating curator the rights reasonably necessary to create and publish the campaign's promotional content, including the use of the track's title, artwork, and links and the artist's and curator's names.

You represent that you have all rights and permissions necessary for the content you submit, and that its use through Soundmango will not infringe third-party rights or violate applicable law.

We may remove content that violates these terms, applicable law, third-party rights, or our quality and safety standards. If you believe content on the platform infringes your rights, including a copyright, contact us at hello@soundmango.com with a description of the content, its location, and the reason for your report, and we will process valid notices in accordance with applicable law.

Acceptable use

You may not use Soundmango to:

  • Circumvent the requirements on playlist editorial independence
  • Manipulate streams, followers, saves, engagement, or other metrics
  • Circumvent our fees or arrange prohibited transactions after connecting through the platform
  • Misrepresent ownership of a track, playlist, or account
  • Impersonate another person or entity
  • Interfere with our security, quality review, deliverable checks, or anti-abuse systems
  • Use bots, unauthorized scraping, or automated systems to access the platform
  • Upload malicious software or harmful code
  • Engage in fraudulent, deceptive, unlawful, or abusive conduct

We may investigate suspected violations, and may restrict or suspend accounts, campaigns, playlists, payments, or payouts while an investigation is ongoing where reasonably necessary.

Third-party platform terms

Soundmango is an independent service and is not affiliated with, endorsed by, or acting on behalf of Spotify or any other streaming platform unless expressly stated otherwise. We are not responsible for any action a streaming platform takes against your account, playlist, or track.

Third-party platform rules may change. We may modify, restrict, or discontinue features where reasonably necessary to maintain compliance, protect users, or reduce platform risk.

We may take action against accounts, tracks, or playlists associated with suspected artificial streaming, fake engagement, or other conduct that could put artists, curators, Soundmango, or third-party platforms at risk.

Payments & fees

All prices, earnings, and refunds are in US dollars. Soundmango accepts card payments through Stripe, and by paying on our platform you also agree to Stripe's terms. Stripe's own processing and currency conversion fees are separate from anything we charge.

Artists see the full price before they pay and are charged in full when they purchase a campaign. We hold the payment until the campaign completes or closes.

Curator earnings relate to campaign work accepted and completed through Soundmango, and are subject to the separation described under playlist editorial independence above. The earnings for a campaign are shown to the curator before acceptance. Earnings become available when the campaign is complete, and a monthly payout run transfers the curator's available balance to their bank account. Any third-party payout cost is disclosed in the payout flow.

Payout eligibility depends on completion and verification of the campaign deliverables, and on the curator providing the information required by our payout provider, tax rules, and applicable law. We may withhold payouts until that information is complete. Curators are responsible for their own tax obligations, unless the law requires us or a payment provider to withhold, report, or collect amounts on their behalf.

If you have a concern about a charge, contact us before disputing it with your card issuer. A chargeback filed without contacting us may result in your account being suspended while we investigate.

Refunds & cancellations

The artist is refunded in full, automatically, if the track does not pass our quality review, if no fitting playlist exists, if no fitting curator accepts the campaign, or if the artist cancels before activation.

Once a campaign has been activated, refund eligibility is based on delivery of the campaign deliverables, not on playlist or streaming outcomes. If a curator does not complete the deliverables within the duration, we first look for a replacement curator to deliver the campaign at no extra cost. If no replacement is found, we refund the artist in full, or for the undelivered part where some deliverables were completed and cannot be replaced.

Beyond these cases, all sales are final and we do not offer refunds unless required by applicable law. Refunds are returned to the original payment method where reasonably possible, and processing times may depend on the payment provider and financial institution. For any question about a payment or refund, email hello@soundmango.com.

Consumer rights

If you are a consumer, you may have statutory cancellation, withdrawal, or refund rights depending on your country of residence. If you are a consumer in the European Economic Area, you normally have 14 days to withdraw from a contract for services.

Because quality review and matching begin as soon as you purchase a campaign, the checkout flow asks you to expressly request that we begin performance immediately and to acknowledge that you lose your right of withdrawal once the campaign has been fully performed. If you withdraw while performance is under way, you pay a proportionate amount for what has already been delivered. Before activation, we refund in full regardless.

Nothing in this section or elsewhere in these terms removes or limits consumer rights that cannot legally be waived.

Data privacy & security

Our collection and use of personal data are described in our privacy policy, which forms part of these terms.

We may use track, campaign, playlist, and curator-decision data to operate the platform, improve matching, detect fraud and artificial activity, improve future campaigns, and develop our services, subject to applicable data-protection law and our privacy policy.

Intellectual property

All content on the platform other than user content, including our partner site, is the property of Soundmango and protected by copyright and other intellectual property laws. Unauthorized use is prohibited.

Our matching methods, scoring systems, quality models, pricing logic, anti-fraud methods, deliverable checks, internal processes, and underlying non-public data are proprietary and confidential.

You may not attempt to reverse engineer, reproduce, extract, or exploit these systems, or use the platform to discover non-public details about how they operate.

Service availability & modifications

The platform is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation, and we may perform maintenance that temporarily interrupts it.

We may update, modify, suspend, or discontinue features, campaigns, eligibility criteria, quality standards, or other parts of the platform where reasonably necessary for operational, legal, compliance, safety, or commercial reasons.

Where a change materially affects an active paid service, we will take reasonable steps to complete, replace, or refund the affected service as appropriate.

Disclaimers & warranties

To the maximum extent permitted by law, the platform is provided "as is" and we do not warrant that use of the platform or a campaign will achieve any particular commercial, promotional, or audience result beyond the campaign deliverables expressly purchased.

Matching is based on available data and our assessment of relevance, and results may vary between tracks, artists, playlists, and campaigns.

User-generated content and curator opinions, including campaign feedback, are those of the relevant users and do not necessarily represent our views. Our platform relies on and links to third-party services, including streaming platforms and payment processors, and we are not responsible for their availability, content, or practices.

Limitation of liability

To the maximum extent permitted by applicable law, Soundmango and its affiliates, officers, directors, employees, and agents are not liable for indirect, incidental, special, or consequential loss, including loss of profits, data, use, or goodwill, arising from your use of the platform.

To the same extent, our total liability to you for all claims relating to your use of the platform shall not exceed the total amount you paid us, or that we retained as fees from your payouts, in the twelve months preceding the claim.

Nothing in these terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and any other liability protected by mandatory law.

Indemnification

To the extent permitted by applicable law, you agree to indemnify Soundmango and its affiliates against third-party claims, losses, and reasonable costs arising from your unlawful use of the platform, your infringement of third-party rights, your breach of these terms, or content you submit without the necessary rights.

Dispute resolution

These terms are governed by Danish law, subject to any mandatory consumer protections that apply in your country of residence.

Disputes that cannot be resolved informally are subject to the courts of Denmark, except where mandatory law gives a consumer the right to bring proceedings elsewhere.

Before starting any formal legal proceedings, contact us at hello@soundmango.com so we can try to resolve the matter informally.

Force majeure

We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, war, government action, pandemics, internet or telecommunications failures, or labor disputes. We will make reasonable efforts to notify you and resume performance as soon as practicable.

Severability & entire agreement

If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.

These terms, together with our privacy policy, constitute the entire agreement between you and Soundmango regarding your use of the platform, and supersede all prior agreements or understandings. In the event of a conflict between these terms and the privacy policy regarding data handling, the privacy policy prevails.

Miscellaneous

You may not assign or transfer these terms without our prior written consent. We may do so without restriction, including in connection with a merger, acquisition, or sale of assets.

Our failure to enforce any provision of these terms is not a waiver of it. We may provide notices to you by email or by posting on the platform, and you are responsible for keeping your email address current.

Changes to these terms

We may update these terms from time to time. We will post the updated version on the platform with a revised "last updated" date and, for material changes, email the address on your account or give other notice where required by applicable law.

Continued use of the platform after an update constitutes acceptance of the revised terms to the extent permitted by law. If you disagree, you must stop using the platform.
